JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 308 of the Indian Penal Code and 47(a) of the Bihar Excise Act, 1915. In huge quantity of bottles of Indian made foreign liquor were recovered from a pick up van which was being driven by the petitioner at the time of seizure. The petitioner is admittedly the driver of the aforesaid pick up van. Submission on behalf of the petitioner is that the seized liquor belongs to one Om Prakash, who happens to be licensee and moreover the petitioner is in jail custody since 01.04.2016 and as a matter of fact the seized bottles were being

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 118 of 2016.
