The petitioner had been directed to appear within six months from the order dated 18.03.2015 and pray for regular bail before the Lower Court. The rejection order speaks of nonobservance of the condition of surrender as regards the time frame set down by this Court in Cr.Misc.No.11151 of 2015. As appears from the FIR, it was the guard who was on duty on the ATM Centre who had maneuvered or manipulated after obtaining the card from the informant on the pretext of checking the functioning of the ATM machine after the card had been retrieved from it. The submission is that there is no allegation against any one except the guard and merely because the petitioner could have been standing there in the queue, he could not be said to have
