Petitioner seeks direction for grant of firearm licence in the special circumstances as her brother-in-law (Devar) was shot dead by the miscreants who had also fired upon her another brotherin-law and had assaulted her mother-in-law also for which a police case was registered. In her representation to the District Magistrate, Patna, it is stated that in the jail also accused persons had assaulted the jail superintendent for which another police case has been lodged. She has stated that in the facts and circumstances she had applied for firearm licence but no decision has been taken as yet by

Accordingly, this writ application is being disposed of with a direction to the District Magistrate-cum-Licensing Authority, Patna to take a final decision in the matter of the petitioner on its own merit and in accordance with law within a period of two months from the date of receipt/production of a copy of this order. So far the issue to depute bodyguard/security guard is concerned, it would be open for the petitioner to approach the appropriate authority for that purpose which should take a decision in accordance with law.
