The petitioner seeks bail in connection with Sessions Trial No. 620 of 2013 arising out of Islampur P.S. Case No. 59 of 2013 registered for the offences punishable under sections 147, 148, 149, 341, 337, 307, 120-B, 302 of the Indian Penal Code and 25(1-B)(a) and 27 of the Arms Act.
According to the prosecution case, the petitioner is alleged to have opened fire causing injury on the informant's wife as a result of which she died instantaneously. The prayer for bail of the petitioner was earlier rejected vide order dated 07.11.2014 passed in Cr.Misc. No. 40409 of 2014.
Patna High Court Cr.Misc. No.28327 of 2015 (3) dt.05-08-2015 2/2 It would be evident from the report called for from the trial court that out of 17 prosecution witnesses, 13 have already been examined during trial.
Regard being had to the facts and circumstances of the case, I find no reason to take a different view in the matter. Accordingly, the application is dismissed.
The court below is directed to expedite the trial and conclude the same as early as possible.
