ANJANA MISHRA ORAL ORDER 31-05-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 23.02.2016 in connection with NTPC Khaira P.S. Case No. 04 of 2013 registered for the offences punishable under Sections 25(1b)a/26/35 of the Arms Act and Section 17 of the CLA Act. Learned counsel for the petitioner submits that there was no recovery from the conscious possession of the petitioner and similarly situated co-accused has taken the name of the petitioner before the police which has been got no evidentiary value in the eye of law. He further submits that similarly situated other co-accused namely Birhaspati@ Brihaspat Jee @ Brihaspat Yadav has been extended the

Patna High Court Cr.Misc. No.23301 of 2016 (2) dt.31-05-2016 2/2 privilege of regular bail in Criminal Miscellaneous No. 3093 of 2016 vide order dated 02.02.2016.

In view of the aforementioned facts and circumstances, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with NTPC Khaira P.S. Case No. 04 of 2013.
