1. Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition Excise Act, 2016.

3. It is alleged that 26.625 liters of illegal foreign liquor was recovered from the Bhushkar.

4. It is submitted that petitioner has been made accused in this case only on suspicion. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent.

5. Learned counsel for the State opposed the prayer for bail.

6. Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge VII Cum Special Judge Excise II, Madhepura in connection with Madhepura Excise Police Station Case No. 171 of 2021-22 related to the Excise Case No. 719 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
