====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 18-06-2019 Heard learned counsel for the petitioners and learned counsel for the State.

In this case, the petitioners are seeking anticipatory bail in connection with Sahebpur Kamal P.S. Case No.227 of 2018, registered for the offence punishable under Sections 363, 366 (A)/34 of the Indian Penal Code.

Allegation against the co-accused including the petitioners is to have kidnapped the daughter of the informant for committing her murder, however, the statement of the victim

Patna High Court CR. MISC. No.37074 of 2019(2) dt.18-06-2019 2/2 girl recorded under Section 164 Cr.P.C. itself shows that she had gone to the house of her 'Nani', as she failed to carry the mobile phone, she could not contact her parents and on that account the present case has been lodged. She has denied that she was not kidnapped by the petitioners.

Looking to the entire facts and circumstances of the case, let the petitioners, above-named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Begusarai, in connection with Sahebpur Kamal P.S. Case no.227 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
