The petitioner is languishing in custody since 03.02.2016 in connection with Tariyani P.S. Case No. 02 of 2016 for the offences instituted under Sections 387 and 506 of the IPC. It is alleged that on 30.12.2015 at about 5.59 P.M. the informant received unknown call from Mobile No. 918945927237 on his Mobile No. 9801038125 regarding demand of Rs. 10,00,000/- as a Rangdari Tax and if demanded amount not paid he will be killed. The informant seeks security of his life and property.
It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.23780 of 2016 (4) dt.05-08-2016 2/2 petitioner is in custody since 03.02.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses against the petitioner. He is not named in the F.I.R. His name has come in course of investigation. There is no direct or indirect evidence against him. On behalf of the State it has been submitted that on trapping of phone calls the petitioner was also in touch with the other accused persons. The petitioner has got as many as six cases pending against him.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. The same is rejected in Tariyani P.S. Case No. 02 of 2016, pending in the court of the learned C.J.M., Sheohar .
