2. The petitioner is in custody since 19.04.2016 in connection with Motipur P.S. Case No. 103 of 2016 for the offence alleged under Sections 47, 49 and 50 of the Excise Act.

3. It is submitted that the petitioner has been falsely implicated as he was not arrested at the place where toddy was allegedly being sold rather he was arrested after chase. It is further submitted that in any event, even according to the accusation in the first information report, toddy was not being sold on the public place but in front of the house. None of the so-called customers have been arrested nor even they have been made accused in the FIR.

4. In the aforesaid facts let the above named petitioner

Patna High Court Cr.Misc. No.22144 of 2016 (2) dt.20-05-2016 2/2 be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Muzaffarpur in connection with Motipur P.S.
