JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 This is an application for grant of anticipatory bail in connection with Chauri P.S. Case No. 100 of 2018, disclosing offences under Sections 420 & 406 of IPC.
Prosecution story is that petitioner has handed over the land to the informant for a period of 1.06.2018 to 31.10.2019 for storage of sand but thereafter, he executed another deed in favour of Subhash Mishra for the same land. Submission of the learned counsel for the petitioner is that he is an old age person and lease of the land has already been cancelled in favour of Subhash Mishra by an affidavit. Heard learned A.P.P. also.
In this case notice was issued to the opposite party no.2, it appears from the office note that opposite party no.2 has received the notice, but no one appears on his behalf.
