JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-12-2020 In view of the submission and undertaking of the learned counsel for the petitioner, at the time of hearing of this application, through Video Conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 04.12.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard learned counsel for the petitioner and the learned A.P.P. for the State, through Video Conferencing. The petitioner seeks bail in connection with Azamnagar (Salmari O.P.) P.S. Case No.106 of 2020 registered under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code.

No.33088 of 2020(2) dt.17-12-2020 2/3 The accusation is that on 22.05.2020 at about 09.00 A.M., Ahsanul Haque (petitioner), Sanjida Begum, Arshad, Rajaul and Dilwar having bhala, sword and garasa in their hands came at the door of the informant Salim and started to fix the bamboo, closing the public path, connected with the door of the informant. When the informant made protest, then Ahsanul Haque (petitioner) gave the sword blow at his forehead, casing injury on his forehead, due to which the informant fell down on the ground having become unconscious. Thereafter, Arshad caused injury through sword on the forehead of Mukhtar, the son of the informant, due to which he also fell down on the ground having become unconscious. At that time, Dilwar and Rajaul caused injury on the leg of Samshad, Dastgir and Sahnawaj through lathi and rod and Sanjida Begum, entering into the house of the informant, took cash Rs.8000/-, after breaking the box.

Learned counsel appearing on behalf of the petitioner submits that due to neighbouring dispute, the scuffle took place between the parties in which several persons sustained injuries. The petitioner has no criminal antecedent and is in custody since 23.05.2020.

Having regard to the facts and the circumstances of
