This application, for grant of regular bail, arises out of Barh P.S. Case No. 02 of 2016, disclosing offences under Sections 25(1-B)A, 26 and 35 Arms Act.

The petitioner is said to be in custody since 02.01.2016. Allegedly, from his possession one automatic pistol made in U.S.A. of 9 MM born was recovered. Learned counsel for the petitioner has submitted that no cartridge was recovered from his possession. It has further been submitted that according to ballistic report, the pistol, recovered from the possession of the petitioner, has been found to be country made. It has further been submitted that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.23134 of 2016 (2) dt.26-05-2016 2/2 Considering the submission, as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh (Patna), in connection with Barh P.S. Case No. 02 of 2016.

This is subject to the condition that the petitioner, abovenamed, shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
