JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Birpur P.S. Case No.27 of 2016 registered under Sections 414 and 120/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the name of the petitioner transpired on the basis of confessional statement of co-accused who was apprehended by the police with the stolen motorcycle.

I have heard learned counsel for the parties and perused the materials on record.

Regard being had to the nature of allegation coupled with the fact that the petitioner had been made accused in at least

Patna High Court Cr.Misc. No.21756 of 2016 (2) dt.20-05-2016 2/2 two other cases out of which one is of identical nature, I am not inclined to grant him bail for the present. Accordingly, prayer for bail is rejected.

The learned Additional Chief Judicial Magistrate, Birpur at Supaul, before whom the matter is pending, is directed to proceed with the trial forthwith. In case the trial is not concluded within seven months from the date of framing of charges, the petitioner would be at liberty to renew his prayer for bail before the court below itself.
