The petitioner seeks bail in anticipation of his arrest in connection with Dumariyaghat P.S. Case No. 05 of 2018, dated 12.01.2018, instituted for the offence under Section 394 of the Indian Penal Code.

The petitioner is not named in the F.I.R. and his implication in this case is on the basis of confession of an arrested accused person in another case.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.32632 of 2020(2) dt.20-02-2021 2/2 that he was made accused earlier in three cases but in all such cases, he was not named in the F.I.R. and has also been granted bail in all such cases. It has further been submitted that nothing incriminating also has been recovered from the possession of the petitioner.

Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Chief Judicial Magistrate, East Champaran, Motihari in connection with Dumariyaghat P.S. Case No. 05 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
