JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Sugauli P.S. Case No.282 of 2013 registered under sections 387 read with 34 of the Indian Penal Code and 27 of the Arms Act. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 16.10.2014 passed in Cr. Misc. No.36455 of 2014 with a direction to the court below to expedite the trial and conclude the same as early as possible preferable within seven months from the date of receipt/production of a copy of the order failing which liberty was granted to the petitioner to renew his prayer for bail. It has been contended that despite lapse of the aforesaid period of seven months, the trial has not commenced. It has further

Regard being had to the facts and circumstances of the case, the petitioner named above, who is said to be in custody since 30th September, 2013, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, East Champaran at Motihari in connection with Sugauli P.S.
