1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Kesariya P.S. Case No. 267 of 2024 dated 17.08.2024 registered under Section 96, 3(5) of the B.N.S. 2023.

3. As per the first information report the daughter of the informant, aged about 16 years, was missing since 29.07.2024. It is alleged that she used to talk to the petitioner and Dilkhush Kumar and they were seen talking several times.

4. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has been implicated in this case on the ground that the victim girl wanted to marry the petitioner but this was being opposed by her family members. The victim girl has been recovered and her statement was recorded under section 164 Cr.P.C. in which she

No.36993 of 2025(2) dt.25-06-2025 2/2 has voluntarily said that no one had kidnapped / abducted her and she had willingly left her house and has performed marriage with the petitioner. She was in love relation with the petitioner for the last 2-3 years. The victim girl has disclosed her age before the learned Magistrate at the time of recording of her statement under Section 164 Cr.P.C. as 18 years.

5. Regard being had to the submission made by the parties and taking into consideration the statement of the victim girl recorded under Section 164 Cr.P.C., I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Motihari, E. Champaran in connection with Kesariya P.S. Case No. 267 of 2024 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
