Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner seeks bail in a case registered for the offence punishable under Sections 406, 407, 420, 120-B of IPC.

Allegation is that accused persons including the petitioner convinced the complainant/informant & others to deposit Rs.2000/- per month and after 36 months Trikon Corporation will pay Rs.1,00,000/-.

It is submitted that there is no specific allegation against the petitioner. From perusal of the complaint petition

Patna High Court Cr.Misc. No.29516 of 2015 (2) dt.12-08-2015 2/3 it appears that money has been given to the accused Shrawan Kumar for which receipts were granted to him. However, after investigation charge-sheet has already been submitted and there is no chance of tampering with the witnesses. The petitioner has no criminal antecedent.

Learned counsel for other side submits that the petitioner is also one of the accused who had encouraged the complainant/ informant to open the account.

Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Sri R. K. Verma, learned Judicial Magistrate, 1st Class Barh, Patna/court concerned in Mokama P. S. Case No. 193 of 1999 with following conditions:- 1.

The petitioner will not indulge himself in similar or any other offence.

One of the bailors must be the close relative of the petitioner.

The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his
