JUSTICE VIKASH JAIN ORAL ORDER 12-02-2021 Heard learned counsel for the petitioner and learned APP for the State. Learned counsel for the petitioner has filed an undertaking to remove all the defects pointed out by the Stamp Reporter as and when required. It is accordingly directed that all defects pointed out by the Stamp Reporter be removed within one month hereof.
2. The petitioner is in custody since 28.01.2020 in connection with Sessions Trial No. 10 of 2020(134/20) arising out of Belaganj P.S. Case No. 52 of 2015 for the alleged offences under Sections 147, 148, 149, 341, 447, 323, 325, 307 and 302 of the Indian Penal Code.
3. It is submitted that the petitioner has been falsely implicated in connection with alleged assault on the father of the informant and other persons of the informant's side. It is submitted that the accusation of assault is general and omnibus in nature against as many as 17 FIR named accused persons including the petitioner, who himself is an aged person of about 80 years. The petitioner claims clean antecedents and has already suffered more than one year in custody.
4. Learned APP, on the other hand, refers to the case diary to submit that four persons have been injured, two of whom have suffered grievous injuries.
5. Be that as it may and having regard to the advanced

No.32971 of 2020(4) dt.12-02-2021 2/2 age of the petitionr and the period of custody already suffered since 28.01.2020, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-Vth, Gaya in connection with Sessions Trial No.10 of 2020 (134/20) arising out of Belaganj P.S.Case No. 52 of 2015. if he is not otherwise required in any other case.
6. Office shall follow-up to ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
