This is an application for regular bail on behalf of the petitioners for the offences alleged under Section 414 of the Indian Penal Code, registered in connection with Begusarai Town P.S.Case No. 801 of 2022.

A supplementary affidavit has been filed rectifying the criminal antecedents of the petitioners.

As per allegation, on a secret information, the place of occurrence was raided. Four motor-cycles were recovered and seven persons were apprehended.

The learned counsel for the petitioners has submitted that petitioners are innocent. He has submitted further that on exactly similar footing co-accused Rajesh Kumar has been

Patna High Court CR. MISC. No.37738 of 2023(2) dt.03-07-2023 2/2 granted bail by a coordinate Bench of this Court in Cr.Misc.No. 23123 of 2023. Another co-accused has also been granted bail by a coordinate Bench of this Court in Cr.Misc.No. 15914 of 2023. The petitioners are in custody since 14.12.2022. Considering the above facts and circumstances, let the petitioners, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S.Case No. 801 of 2022, subject to the following conditions:-

1. The petitioners shall cooperate in the disposal of trial and make themselves available on each and every date fixed at the trial till framing of charge, and if they fail to appear on two consecutive dates without any reason or unavoidable circumstances, the court below shall be at liberty to cancel their bail bonds.

2. If the petitioners are found involved in future in the similar type of offence, their bail bonds shall be liable to be cancelled.
