The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 447, 147, 148, 149, 323, 341, 323, 324, 307 of the Indian Penal Code and Section (1-B)a, 26/27 of Arms Act The prosecution case as per F.I.R is that petitioner and co-accused persons came at the house of the informant and fired repeatedly to which the informant narrowly escaped. It is also alleged that pistol and two cartridges were snatched from the petitioner and handed over to police.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in the present case. The petitioner is not apprehended from the

Patna High Court CR. MISC. No.36077 of 2022(2) dt.29-11-2022 2/2 spot. It is submitted that sister of the informant has solemnized marriage with the petitioner and in retaliation of this, the informant lodged an F.I.R. with false and concocted allegations. It is also not logical that in spite of repeated firing attempts, no one was hit. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VI, Patna City in connection with Sultanganj P.S. Case No. 181 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) nirajkrs/- U T
