The petitioners seek bail in Fatuha P.S. Case No. 433/2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and 27 of the Arms Act. The informant is the wife of the deceased and named nine persons and alleged that all the accused persons surrounded her husband Ashok Singh and on the order of Niranjan Singh Ramnandan Singh fired causing death of her husband on the spot. It is submitted that there is no allegation of assault against the petitioners. Similarly situated co-accused Bahadur Singh has already been enlarged on bail.

Considering the facts aforesaid and the fact that petitioners

Patna High Court Cr.Misc. No.30367 of 2015 (2) dt.12-08-2015 2/2 are not assailant of the deceased. Similarly situated co-accused has already been enlarged on bail, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri D.K. Mishra, Judicial Magistrate 1st Class, Patna City, Patna, in connection with Fatuha P.S. Case No. 433 of 2014.
