The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.
The petitioner allegedly caused injury to his brother with a weapon of cutting, as a result whereof, brother of the petitioner died. Wife of the deceased is informant of this case. The occurrence took place for the reason that the deceased after consuming liquor was quarreling with his own wife. Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail for the present in connection with Salimpur P.S. Case No. 107 of 2015. Hence, prayer is refused.
However, learned counsel for the informant submits
Patna High Court CR. MISC. No.33867 of 2020(4) dt.08-02-2021 2/2 that the informant is ready to produce witnesses of the occurrence on each and every date fixed by the court below. In the aforesaid circumstance, learned trial Judge is directed to proceed with the trial on day to day basis without allowing any adjournment if the witness is in attendance and to conclude the trial at the earliest.
