Heard the learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Munger Mahila P.S. Case No. 53 of 2019, registered for the offences punishable under Sections 498A, 313, 506 & 34 of the Indian Penal Code and section 3 & 4 of the Dowry Prohibition Act.

As jointly prayed, the matter has been settled after

Patna High Court CR. MISC. No.38185 of 2022(6) dt.19-04-2023 2/3 mediation and as per terms and conditions of the compromised, the demand draft of Rs. 1 lakh (bearing DD No. 758986 dated 18.04.2023) as first installment of the settled amount is being provided to the learned counsel for the informant. The learned counsel for the informant has submitted that the petitioner shall obey the terms and conditions of compromise and shall provide the rest amount of Rs. 5,75,000/- within nine months.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released provisionally on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Munger in connection with Munger Mahila P.S. Case No. 53 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.

After payment of all the amount within the stipulated period of time, the learned court below shall confirm the bail bond of the petitioner.

In the meantime, the informant shall also adhere to his words and shall withdraw all the cases against the petitioner.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
