2. Petitioner seeks a direction to the respondents to appoint her as a peon. Petitioner had applied pursuant to an advertisement dated 15.11.2019, final select list dated 10.02.2020 (Annexure 5) was also issued nearly one year prior to filing of the present writ petition.

3. The specific stand of the respondents in the

Patna High Court CWJC No.468 of 2021(7) dt.11-09-2023 2/2 counter affidavit which have duly been served on the petitioner's counsel is that the petitioner's requisite qualification i.e., Matriculation is claimed from the Central Board of Higher Education, which is not a recognized Board. The stand is not denied or disputed by filing any rejoinder or reply to the counter affidavit.

4. The learned counsel for the Bank has drawn attention of the Court also towards Annexure R/2 Series, to submit that under similar circumstances when degree was submitted from similar bodies having no recognition in the eyes of law, it has been held that the candidature of such persons cannot derive any sustenance from such certificates.

5. The facts being not in dispute this Court find that no case is made out in the writ petition and the same is dismissed.
