The petitioners seek bail in a case registered for the offences punishable under Sections 414, 413, 420 and 120(B) of the Indian Penal Code.

Having got confidential information regarding selling of stolen motorcycle the police went there and found that three persons were standing near an Apache motorcycle. Spotting the police the accused persons tried to flee away, but on chase Sharma Prasad, Rohit Kumar the petitioners and Saba Karim were apprehended. Saba Karim is said to have confessed his guilt and disclosed that he was talking for selling the motorcycle. It is submitted that the case of the petitioners stands on

Patna High Court Cr.Misc. No.31226 of 2015 (3) dt.29-09-2015 2/2 the same footing as that of Saba Karim. The petitioners are in custody since 02.03.2015. The petitioners had already remained in jail for seven months. Saba Karim has already been enlarged on bail vide orders passed in Cr. Misc. No. 21906 of 2015. Coaccused Jamadar Das has also been enlarged on bail vide orders passed in Cr. Misc. No. 19285 of 2015.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari in Kotwa P.S.
