The petitioners are apprehending their arrest in connection with Mehandiya P.S. Case No. 16 of 2016 for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

The prosecution case is that on 6.2.2016 at about 8.30 A.M., the Informant was standing his cycle in front of his door. In the meantime, the wife of the younger brother of the Informant started abusing which was protested by the Informant and she called her husband Lalendra Ram, petitioner no.2 and thereafter Lalendra Ram assaulted by Lathi on the head of the Informant as a

Patna High Court Cr.Misc. No.23299 of 2016 (2) dt.24-05-2016 result he became unconscious. In the meanwhile, the brother of the Informant came to rescue then he was also assaulted. Learned counsel for the petitioners has submitted that the injuries of the Informant and his brother have been found superficial and simple in nature and for a petty dispute, the accusation has been levelled. It has also been submitted that the petitioners are non-else but, the brother and brother's wife of the Informant.

Considering the nature of accusation, let the petitioners, above named, in the event of arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Mehandiya P.S. Case No. 16 of 2016 subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Rishi/- U T
