JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 16-06-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner has approached this Court for a direction to the respondents to pay pension and other pensionary benefits including arrears of difference of salary, GPF amount, gratuity, earned leave encashment with interest and also grant the benefit of ACP outstanding to the petitioner.

Learned counsel appearing on behalf of the petitioner would submit that the petitioner superannuated on 31.12.2017 and necessary pension papers for sanction of post retiral dues

Patna High Court CWJC No.10719 of 2019 dt.16-06-2020 2/2 has been submitted but payment of post retiral dues has not been made.

Considering the aforesaid, the writ petition is disposed of with a direction to the respondents to ensure payment of retiral benefits as well as decide the claim of the petitioner for benefit of ACP under ACP Scheme at the earliest preferably within a period of three months from the date of receipt/production of a copy of this order failing which the entire amount shall carry interest at the rate of 9% per annum from the date of filing of the writ petition i.e. 09.05.2019 till the date of actual payment which shall be realised from erring officers. With the aforesaid observation and direction, the present writ petition stands disposed of.
