The petitioner, who seeks bail in a case registered for the offence punishable under Sections 302, 201/34 of IPC, is in custody since 6.2.2015.

Allegation against the petitioner and co-accused Arjun Sah is that prior to one day of the occurrence they had given threatening and on the next day the dead body of the deceased has been found. It has been suspected that they might have killed the brother of the informant (deceased).

It is submitted that only suspicion has been made against the petitioner and in similar facts and circumstances coaccused Arjun Sah has been granted bail by this Court vide Cr. Misc. No. 45605 of 2014.

Patna High Court Cr.Misc. No.28479 of 2015 (2) dt.11-08-2015 2/2 Learned counsel for the State submits that Arjun Sah has no criminal antecedent, whereas, the petitioner has criminal antecedent.

Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Samastipur/court concerned after framing of charge in Dalasing Sarai P. S. Case No. 334 of 2014 with following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
