JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-03-2021 Heard Mr. Sunil Kumar, learned Advocate for the petitioners and Mr. Paras Nath, learned counsel for the informant. The State is represented by the learned APP. The petitioners seek bail in anticipation of their arrest in connection with Kurtha P.S. Case No. 143 of 2020, dated 04.07.2020, instituted for the offences under Sections 341, 342, 323, 307, 379, 504 and 506/34 of the Indian

Patna High Court CR. MISC. No.33558 of 2020(2) dt.12-03-2021 2/3 Penal Code.

The petitioner No. 1 is said to have assaulted the informant and his wife by means of lathi, whereas the petitioner No. 2 is said to have assaulted the son of the informant by means of khanti.

Learned counsel for the petitioners has drawn the attention of this Court to the injury report of the three persons said to have been injured in the occurrence. All the injuries have been opined to be simple in nature. There is a counter version of the occurrence as well. A past dispute between the parties is the basis for the occurrence, which is said to have taken place in which the petitioners have been made accused.

Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in
