JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 409/34 of the Indian Penal Code.
The prosecution case is that the petitioner and two others being Assistant in the Circle Office, Bettiah, failed to hand over records of Settlement Case no. 3/95-96, Rent Determination Case no. 62/62-63 and Encroachment Case No. 3/05-06 at the time of their transfer from the Circle Office.
It is submitted by the learned counsel for the petitioner that the charges of the above records were never given to the petitioner and others and the said fact has also surfaced during
Patna High Court Cr.Misc. No.28467 of 2015 (2) dt.24-07-2015 2/2 investigation which has been recorded by the learned Sessions Judge while disposing of the bail application of co accused persons. It reflects from the impugned order that till date no departmental proceeding has been initiated against the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, West Champaran, Bettiah in connection with Bettiah Mufassil P.S. Case No. 141 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
