Heard the parties.

The petitioner is languishing in custody for the offence punishable under Sections 376/302/313/364/420/498(A)/34/323/325 of the Indian Penal Code and Sections 3⁄4 of the D.P. Act.

The main allegation in the complaint based F.I.R. is against co-accused Subodh Kumar to have physically exploited the complainant on the pretext of marriage and later on refused to marry with the complainant. A girl child took birth and thereafter accused persons were instigating the complainant to commit suicide. Petitioner is cousin of said Subodh Kumar.

Patna High Court CR. MISC. No.32548 of 2020(2) dt.15-12-2020 2/2 Petitioner has got no criminal antecedent. Investigation of the case is already complete.

Considering the lack of sufficient material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Goraul P.S. Case No. 408 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
