Petitioner is apprehending his arrest in connection with Complaint Case No.1066C of 2017 , registered for offences punishable under Sections 498A, 494 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. Prosecution story as per the complaint petition is of demand of one motorcycle and Rs.02 lac . It further appears that the demand of the motorcycle was fulfilled but due to nonfulfillment of the demand of Rs.02 lac, she was ousted form the house and she was also ousted and subjected to torture. In this case notice was issued to the Opposite Party No.2 and it appears that she has received notice personally on 22.6.2019 but nobody appears on behalf of O.P.no.2 nor any Vakalatnama has been filed on her behalf.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the learned court below on 26.8.2019 and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Khagaria in connection with Complaint Case No.1066C of 2017, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that she is ready to reside with the petitioner and he has to keep her with dignity and care and further condition that if Opposite party no.2 files a case for maintenance, he has to co-operate in disposal of the same and abide by the order either interim or final passed in the Maintenance case unless
