ANJANA MISHRA ORAL ORDER 01-06-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is in custody since 12.01.2016 in connection with Barachatty (Mohanpur) P.S. Case No. 2/2016 registered for the offences punishable under Sections 147,302,120(B) and 379 of the Indian Penal Code. Learned counsel for the petitioner submits that while celebration was going on for the new year on 01.01.2016 and the son of the informant was participating in the same along with others, certain free fight took place and the informant's son being equally drunk, fell down in the well. However, since the petitioner and other co-accused were present at the said celebration, they have been named in the F.I.R with false intention. Learned counsel
Patna High Court Cr.Misc. No.23338 of 2016 (2) dt.01-06-2016 2/2 for the petitioner further submits that similar situated other coaccused persons, namely, Punjabi Mandal @ Punjabi Manjhi, Surendra Manjhi, Kamlesh Manjhi @ Kara Manjhi and Dayanand Bhuiyan @ Dyanand Manjhi have been extended the privilege of regular bail in Criminal Misc. No. 19721 of 2016 vide order dated 11.05.2016 and Criminal Miscellaneous No. 20422 of 2016 vide order dated 13.05.2016 respectively and hence, the petitioner may be extended the privilege of regular bail.
In view of the aforementioned facts and circumstances and that there is general and omnibus allegation against the petitioner, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati, District-Gaya in connection with Barachatty (Mohanpur) P.S. Case No. 2/2016.
