JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 26-05-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of regular bail, arises out of Pusa P.S. Case No. 131 of 2014, disclosing offences under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner was not named in the F.I.R. and his name appears to have surfaced on the basis of confessional statement of co-accused before the police, recorded in course of investigation.
From paragraph 3 of the application, it appears that the petitioner is an accused in another case for an offence punishable under Section 302 of the Indian Penal Code, in
Patna High Court Cr.Misc. No.23107 of 2016 (2) dt.26-05-2016 2/2 which he is said to be on bail.
Considering the antecedent of the petitioner, I am not inclined to grant him regular bail.
This application is, accordingly, rejected.
It is observed that the court below shall make sincere endeavour to ensure conclusion of the trial arising out of the present Pusa P.S. Case No. 131 of 2014 and Pusa P.S. Case No. 197 of 2001. If there is no substantial progress in trial, the petitioner shall also be at liberty to renew his prayer for bail after six months.
