The petitioner apprehends his arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is In-charge Head Master of Middle School Dihuli, Ishaque Hindi, Sakara Muzaffarpur, it is next alleged that an amount of Rs. 4 lakh and odd was sanctioned to the petitioner for completing some work out of which work worth 2,40,000/- and odd was completed and some amount remained which was disputed.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.68830 of 2021(3) dt.25-07-2022 2/2 petitioner has already deposited the said amount of Rs. 2,62,039/- (with interest) by cheque as would be evident from Annexure-2 to the anticipatory bail application on which the Block Education Officer has given no objection to the petitioner. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sakra P.S. Case No. 595 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
