Patna High Court CWJC No.982 of 2021 dt.10-11-2022 2/3 The present application has been filed seeking direction upon the Respondent to re-calculate the amount applying the statutory rate of interest over the GPF amount. Learned counsel for the petitioner fairly submit that earlier the substantive amount under the head of GPF was paid to the petitioner, however, the same was much lesser to his entitlement. The petitioner made representation before the District Program Officer as well District Provident Fund Officer, Patna, along with the chart showing discrepancies in the calculation. On receipt of the aforesaid representation, certain queries have been made and in response to the aforesaid queries, the petitioner submitted the requisite necessary documents/papers before the concerned authorities, but till date no final order has been passed by the District Program Officer, Patna.
At this juncture learned counsel for the State Submits that if the petitioner would file a fresh representation along with all the necessary documents in support of his claim, the same would be considered by the District Program Officer, Patna. Considering the submissions made on behalf of the parties and having gone through the materials available on the record, this court directs the petitioner to file a representation along with the calculation chart and necessary documents in
Patna High Court CWJC No.982 of 2021 dt.10-11-2022 3/3 support of his claim before the District Program Officer, Patna, within a period of four weeks from today.
If such representation is filed on behalf of the petitioner, the respondent District Program Officer, Patna, shall consider the same and pass reasoned and speaking order preferably within a period of six weeks, thereafter.
It is needless to say that if the petitioner would be found entitled to any further amount under the head of GPF, the order for payment would be passed within the aforesaid period. Accordingly, the present writ application stands disposed of.
