This application, for grant of regular bail, arises out of Warisaliganj P.S. Case No.266 of 2015, disclosing offences under Sections 302 and 201/34 of the Indian Penal Code.

Learned counsel, appearing on behalf of the petitioner, has submitted that petitioner is not named in the First Information Report and his name has surfaced on the basis of confessional statement of co-accused, namely, Gopal Singh, before the police. He has submitted that over

Patna High Court Cr.Misc. No.23080 of 2016 (2) dt.26-05-2016 2/2 and above the said confessional statement, there is no material against the petitioner. It has further been submitted that other co-accused persons, namely, Prahalad Singh and Dhiraj Kumar @ Dhiraj Kumar Singh, have been granted bail/anticipatory bail by this Court vide orders, dated 04.05.2016, passed in Cr. Misc. No.18954 of 2016, and 18.03.2016, passed in Cr. Misc. No.5520 of 2016. Considering the submission that other coaccused persons have been granted bail/anticipatory bail by this Court, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.

10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Nawada, in connection with Warisaliganj P.S. Case No.266 of 2015. This is subject to the condition that the petitioner, abovenamed, shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
