1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Sahajitpur P.S. Case no. 171 of 2024 registered under sections 303(2) and 317(2) of the Bharatiya Nyaya Sanhita, 2023 and sections 25(1-B)(a), 26 and 35 of the Arms Act.
3. As per the prosecution case, a country made pistol and a foldable knife was recovered from the possession of the petitioner besides other articles being recovered from the possession of the co-accused.
4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner's possession who has been has been falsely implicated in the case. He is in custody since 10.12.2024, has no criminal antecedent
Patna High Court CR. MISC. No.34979 of 2025(2) dt.09-06-2025 2/2 and charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R, the petitioner being in custody for about 6 months since 10.12.2024 and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Sahajitpur P.S. Case no.171 of 2024, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Saran at Chapra.
