2. The petitioner is in custody since 23.03.2016 in connection with Obra P.S. Case No. 29 of 2016 for the offence alleged under Section 392 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated and there is no material to connect the petitioner with the alleged offence. The petitioner's name has surfaced on the confessional statement of one Ranjit Bahadur who has not been made accused nor arrested. The recovery of the looted articles has been made in part from Jai Mata Di Rice Mill of one Mano Singh. The petitioner claims clean antecedent.

4. Having regard to the entirety of the facts and circumstances of the case, let the above named petitioner be

Patna High Court Cr.Misc. No.22130 of 2016 (2) dt.20-05-2016 2/2 released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Obra P.S. Case No. 29 of 2016, subject to the following conditions:- (i) The petitioner shall cooperate with the investigation and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.

(ii) The petitioner shall remain physically present on each and every date during trial and in the event of failure to appear on three consecutive dates without sufficient reasons; his bail bond shall be liable to be cancelled by the learned Court concerned.
