The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, the petitioner is said to have sent a consignment of 396 litres of IMFL which was recovered on secret information having been received. It is submitted by learned counsel for the petitioner that the petitioner is simply a parcel agent and the parcel was booked at Ludhiana by one Pappu Kumar and his brother was to receive the parcel at Hajipur. The petitioner was not aware of the contents of the parcel while booking the same at Ludhiana in Punjab where liquor is not banned. The petitioner is in custody

Patna High Court CR. MISC. No.45248 of 2021(2) dt.29-01-2022 2/2 since 14.4.2021 and has no criminal antecedent. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having any criminal antecedent and having remained in custody for more than 9 months, the Court directs the petitioner to be enlarged on bail in connection with Rail Sonepur-Hajipur P.S. Case no. 35 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Excise Court, Vaishali at Hajipur on the following conditions.

(i) One of the bailors shall be a close relative of the petitioner.

(ii) The other bailor of the petitioner shall be resident of a place within the jurisdiction of the learned trial Court. (iii) The petitioner shall cooperate in the trial. (Partha Sarthy, J) Prakash/- U
