The petitioner is in custody since 09.09.2015 in connection with Bakhtiyarpur P.S. Case No. 295 of 2015 registered for the offences punishable under Sections 399/402 of the of the Indian Penal Code and Section 25 (1-B)A/26/35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner was named in the FIR on the basis of the statement made before the Police by one co-accused and as such, the petitioner has been taken into the custody. It is further submitted that the petitioner has not been put on T.I. Parade and
Patna High Court Cr.Misc. No.23277 of 2016 (2) dt.01-06-2016 no recovery has been made from his possession. Considering the period of custody and also the fact that the petitioner has got no criminal antecedent, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned A.D.J. 1st Barh, Patna in connection with Bakhtiyarpur P.S.
