The petitioner seeks bail in a case registered under Sections 147, 148, 149, 353, 307 of the Indian Penal Code, Section-27 of the Arms Act and Sections-16, 17, 18, 20, 23 of U.A.P. Act.

The prosecution case in short is that while the informant along with police personnel was in search of Nuxlites towards Barmasiya, the Nuxlites started indiscriminate firing and they fled away abusing filthy languages. From the place of occurrence, in huge quantity, arms and other incriminating articles were recovered.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the

Patna High Court CR. MISC. No.36876 of 2019(3) dt.15-07-2019 2/2 petitioner. The petitioner is in custody since 18-12-2018. Charge sheet has already been submitted. General and omnibus allegation has been made against the petitioner. There is no specific allegation of overt act alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II, Lakhisarai in connection with Sessions Case No. 41 of 2019 arising out of Kajara P.S. Case No. 31 of 2018.
