The petitioner is languishing in custody in connection with Sono P.S. Case No.176 of 2015 for the offences instituted under Section 306/34 of the Indian Penal Code. The prosecution story in brief, is that the informant had married his daughter (deceased) with the petitioner about 10 years ago, but she had no issue, hence the petitioner along with her mother-in-law and sister in-law (Gotini) used to taunt that she would not bless any child. On 05.11.2015, the informant came to know that his daughter died by burning. The petitioner along with his family members were absent from the house and thus he informed to the local police.

Patna High Court Cr.Misc. No.23163 of 2016 (5) dt.03-08-2016 2/2 It has been submitted on behalf of the petitioner that petitioner is in custody since 26.03.2016. Charge sheet has been submitted in this case. There is no criminal antecedent against the petitioner. There is no allegation of tampering of the witnesses against the petitioner. The alleged occurrence has taken place after 10 years of marriage. It has been stated that deceased was issueless and hence she has committed suicide. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jamui, in connection with Sono P.S. Case No. 176 of 2015.
