Arora, Senior Advocate alongwith Mr. Manoj Kumar, learned counsel for the petitioner, Mr. Jagdhar Prasad, learned A.P.P. for the State and Mr. Avinash Chandra alongwith Mr. Peeyush Shekhar, learned counsel for the opposite party no. 2, 3 & 4.
The present Cr. Revision Application has been filed by the petitioner against the order dated 24.05.2017 passed in Case No. 1772 of 2016 by Sub Divisional Magistrate, Daudnagar, Aurangabad whereby application filed by the petitioner under Section 147 of Cr.P.C. has been rejected.
Patna High Court CR. REV. No.723 of 2017(2) dt.27-03-2023 2/2 Learned counsel for both the parties jointly admits that petitioner and the opposite parties are agnates. Petitioner is the uncle and the opposite parties are nephew, both have jointly submits that a Nali is required for both the parties and for the said dispute vide order dated 28.11.2022 a Co-ordinate Bench of this Court in C.W.J.C. No. 5785 of 2020 has pleased to pass the order and by the said order, it transpires that the dispute is finally settled and both parties are agreed to obey the said order passed in C.W.J.C. This C.W.J.C. has arisen in the year 2020 whereas the present Cr. Revision is of the year 2017. In this background, that matter has been settled in C.W.J.C. No.
5785 of 2020, this Court is not inclined to pass any order on merit in this case and this case is disposed off on the undertaking of both the parties that they shall respect the order dated 28.11.2022 passed in C.W.J.C. No. 5785 of 2020. State authorities are also suppose to comply the said observation given for them in the writ petition. Accordingly, the present Cr. Revision Application stands disposed off.
