The petitioner who is in custody since 12.01.2019 has filed the instant application for grant of bail in connection with Bajpatti P.S. Case No. 282 of 2018 registered for the offence punishable under sections 147, 148, 149, 341, 323, 324, 307, 379, 376 and 511 of the Indian Penal Code.

As per the allegation in the FIR, the petitioner and others are alleged to have assaulted the informant and her family members.

It is submitted by learned counsel for the petitioner that the case of the petitioner stands on the similar footing to that of co-accused Kale Nadaf who has been enlarged on bail by order dated 02.05.2019 in Cr. Misc. No. 10023 of 2019 and Rizwan Nadaf and five other persons who have been enlarged

Patna High Court CR. MISC. No.38257 of 2019(3) dt.11-09-2019 2/2 on bail by order dated 06.05.2019 in Cr. Misc. No. 10691 of 2019.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration that the similarly situated accused have been enlarged on bail as stated above and that the petitioner has no criminal antecedent, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Pupari, Sitamarhi in connection with Bajpatti P.S. Case No. 282 of 2018.
