JUSTICE SUDHIR SINGH ORAL ORDER 05-08-2015 The petitioner is languishing in custody since 25.04.2015 in connection with Taraiyan P.S. Case No. 85 of 2015 for the offences instituted under Sections 413 and 414/34 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that the informant received secrete information about the motorcycle shop of the petitioner. The shop of the petitioner was raided at about 5.30 P.M. and the petitioner was caught alongwith a stolen motor cycle and on the basis of confessional statement of the petitioner, the house of one Abdu Niwas was searched and on the confessional statement of Abu Niwaz Raju Rai @ Krishna Rai was arrested
Patna High Court Cr.Misc. No.29303 of 2015 (2) dt.05-08-2015 2/2 alongwith stolen Motorcycle. Nothing was recovered from Abu Nawaz.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent and he is in custody since 25.04.2015 and the charge sheet has been submitted in the present case. As per allegation, it is mentioned that the stolen motorcycle is said to have recovered from his possession but the same is denied by the petitioner.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra, in connection with Taraiyan P.S.
