The petitioner, being husband of the complainant is languishing in custody since 27.3.2019 in a case registered for the offences punishable under Sections 498A,323,406,494/34 and 120B of the I.P.C.

The accusation is of torture and performance of second marriage by the petitioner with one Sonia Devi. It is submitted by learned counsel for the petitioner that the marriage between the petitioner and the complainant is admitted and it is the complainant who deserted the petitioner. However, the petitioner is ready to get the issue resolved

Learned counsel for the complainant submits that the petitioner not only inflicted torture upon the complainant but has also performed second marriage.

Considering the nature of accusation, the stand of the petitioner that he is ready to reconcile the issue, coupled with the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM VIII, Vaishali at Hajipur in connection with Complaint Case No. 1781 of 2017. Both sides agree to appear before the learned Court below on 21st June, 2019 when the learned Court below will make efforts to get the issue resolved through the process of mediation.
