The petitioner wants to renew his prayer of bail, which was earlier rejected thrice vide order dated 27.05.2014, 08.10.2015 and 27.01.2016 passed in Cr. Misc. No. 13259 of 2014, 25440 of 2015 and 3487 of 2016 respectively, on the ground that the trial has not yet been concluded and the Investigating Officer is still to be examined.
Learned APP submits that the trial is now likely to be concluded and the petitioner is the assailant. In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail in Sessions Trial No. 927 of 2013 arising out of Chakia P.S. Case No. 122 of 2013 pending in
Patna High Court Cr.Misc. No.23290 of 2016 (2) dt.22-06-2016 the court of learned 9th Additional Sessions Judge, Motihari, stands rejected.
However, learned trial court is again directed to take all positive steps for securing the attendance of I. O. and conclude the trial as early as possible, preferably within two months from the date of receipt/production of a copy of this order. Let a copy of this order be sent to the concerned Superintendent of Police who is directed to ensure the attendance of Investigating officer of this case for his evidence.
