JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is apprehending his arrest in Pirpaity P.S. Case no.104/15 for the offences instituted under Sections 366 and 120(B) of the I.P.C.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that on 13.4.2015 the daughter of the informant Pushpa Kumari aged about 18 years had gone to Pirpainty Bazar to get her clothes stitched but when till evening she could not return back her family members started to search her and in course of search the informant came to know that she was going on a tempo along with one Mithilesh Yadav and Chhotu Yadav towards market and when he came to the house of Chhotu Yadav but Chhotu Yadav was not found in the house.

No.28734 of 2015 (2) dt.23-07-2015 2/2 Thereafter when the informant went to the house of Mithilesh Yadav and enquired about her daughter upon which the accused persons became angry and abused him saying that they all have abducted his daughter in order to marry her with Mithilesh Yadav. It is submitted on behalf of the petitioner that the victim girl has been examined under Section 164 Cr.P.C. which is Annexure-2 to this petition wherein she has not named this petitioner. It is further submitted that the petitioner has got no criminal antecedent.

On behalf of the State it is submitted that the petitioner has been named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Bhagalpur, in Pirpainty P.S.Case No.104/15 subject to the conditions as laid down under Section 438(2) Cr.P.C.
