JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-326(A), 307/34 of the Indian Penal Code. Earlier prayer for bail of the petitioner was rejected by this court but submission on behalf of petitioner is that the petitioner is in jail custody since 03-08-2015 but his trial has not been concluded, as yet.

Learned counsel, appearing for the informant submits that out of 10 proposed prosecution witnesses, three prosecution witnesses have already been examined, however, learned counsel appearing for the informant assures this court that prosecution witnesses shall be produced before the trial court within three

In view of the aforesaid submission, again I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Bahadurpur P.S. Case No. 97 of 2015 corresponding to Sessions Trial No. 02 of 2015 stands rejected. However, it is made clear that if, the trial of the petitioner is not concluded within four months from the date of receipt/production of copy of this order, the petitioner may renew his prayer for bail before the learned trial court itself.
